User Content Policy for Partoska service

I. General Provisions

1. This User Content Policy is an integral and binding part of the Terms and Conditions for the provision of Partoska service for sharing media from events.

2. Capitalized terms and definitions used in this User Content Policy but not defined herein shall have the meaning ascribed to them in the Terms and Conditions (the "Terms").

II. User Content Policy

1. User has the following rights and obligations in relation to User Content:

  • a. The User is entitled to choose the name of the media content uploaded to the Platform. The name of the media content must not contain profanity or expressions that contradict paragraph 2. and/or 3. of this Section II of this User Content Policy. If such name does not comply with the conditions set forth in the preceding sentence or is otherwise inappropriate in content or graphics, the Operator reserves the right to change the name or remove the User Content so named from the Platform or to restrict access to the User Content so named.
  • b. Event Organizers shall, when creating an Event or uploading User Content to the Platform, decide whether to share the User Content publicly or to restrict access to the User Content. Event settings determined by the Event Organizer control the visibility and accessibility of User Content within that Event.
  • c. When uploading User Content as an archive to the Platform, the User may be asked to decide whether the archive will be automatically extracted. All contents of the extracted archive constitute User Content within the meaning of this User Content Policy.
  • d. User agrees to refrain from uploading erotic and/or pornographic User Content to the Platform. In the event that User uploads erotic and/or pornographic User Content to the Platform in violation of this prohibition, such User Content may be removed or made unavailable.
  • e. The Operator reserves the right to move User Content between different parts of the Platform or between storage systems as necessary to provide the Services.
  • f. Users may remove their User Content uploaded to the Platform, subject to the technical capabilities and functionality of the Services.
  • g. User may make User Content inaccessible to other Users (e.g., through Event privacy settings, password protection, or other access restrictions). The specific methods of making unavailable and restricting access to uploaded User Content are governed by the Operator's current offer. By uploading User Content to the Platform, the User may not violate the rules set forth in this User Content Policy.

2. The placement of User Content on the Platform, in particular in relation to the name and content of the uploaded media content and other information stored by the User on the Operator's Platform, must not contravene the law and the Terms, in particular this User Content Policy, as well as the rights and legally protected interests of the Operator, other Users or third parties. In particular, the User may not, by placing User Content on the Platform:

  • a. Infringe copyright, rights related to copyright, trademark rights, trade name, protected designation of origin or industrial rights;
  • b. Incite hatred against a group of persons or limit their rights and freedoms, defame a nation, ethnic group, race and/or beliefs;
  • c. Support or promote movements demonstrably directed at the suppression of human rights and freedoms;
  • d. Encourage a criminal offence, mass failure to perform an important duty imposed by law, or endorse a criminal offence;
  • e. Depict cruelty to an animal;
  • f. Contain a false statement about another that is likely to cause substantial damage to his/her reputation, good name or standing, to damage his/her employment, to disrupt his/her family relationships or to cause him/her other serious harm;
  • g. Promote in any way a business in competition with the Operator or contain material likely to damage the reputation of the Operator;
  • h. Breach a statutory duty of confidentiality or violate or endanger the trade secrets of a third party;
  • i. Distribute inappropriate or harmful files and/or information, in particular viruses, Trojan horses, rootkits, backdoors, spyware, adware, or any other malware;
  • j. Distribute files and/or information that link directly or indirectly to content that does not comply with the requirements of this User Content Policy, including but not limited to URL links, URIs, trackers, torrents, and other links.

3. In particular, a User may not upload User Content to the Platform that:

  • a. Allows persons under the age of eighteen to access any pornographic work or other content capable of impairing the healthy development and/or moral education of minors;
  • b. Contains pornographic works depicting or otherwise exploiting a child or a person appearing to be a child;
  • c. Contains pornographic works that display violence or disrespect for human beings or that describe, depict or otherwise depict sexual intercourse with an animal.

4. The User shall not behave or misuse the Services provided by the Operator within the Platform in a manner that would be contrary to the law, the Terms, as well as the rights and legally protected interests of the Operator, other Users or third parties, e.g. by posting or sending unsolicited commercial messages ("spam") in any way or uploading User Content that limits the functionality of the Services or makes its use by other Users more difficult. Event Organizers are responsible for ensuring that the purpose and use of their Events comply with this User Content Policy.

5. Publishing advertising is reserved to the Operator. User may not post any paid or unpaid advertising or third party advertising on the Platform. In the event of the User publishing advertising, the Operator reserves the right to remove any uploaded User Content that contains advertising, restrict access to such User Content, or limit the User's access to the Services. Violation of this provision shall be considered a material breach of the Terms.

A. Appendix: Child Protection Rules

1. In accordance with paragraph 3. of Section II of this User Content Policy, Operator does not and will not tolerate child pornography posted in any form on the Platform. If Operator becomes aware of the presence of child pornography on the Platform, Operator will promptly take all steps that may be required of it to remove or make child pornography unavailable from the Platform.

2. Operator expressly reserves the right to pursue all legal remedies against the User who has posted child pornography on the Platform, including the rights under the Terms and/or to cooperate with law enforcement authorities to identify those involved in the distribution of child pornography.

3. To report child pornography or other illegal content, please follow the Notification Policy.
